Terms of Service
These terms govern use of kylefyle, an internal event-production management platform owned and operated by Mertz Productions ("Mertz Productions," "we," "us"). By signing in to kylefyle, you agree to these terms.
Who this applies to
kylefyle is not open to the public. Access is by invitation only, extended by Mertz Productions to its employees, contracted crew and vendors, and clients working on a specific event. There is no self-service registration.
Your account
You're responsible for keeping your login credentials confidential and for all activity under your account. Let us know right away if you believe your account has been accessed without authorization.
Acceptable use
kylefyle is provided solely to support the planning and execution of Mertz Productions events. You agree to:
- Use kylefyle only for legitimate event-production purposes related to work you're actually involved in.
- Keep event details, contact information, and internal notes confidential, and not share access with anyone not authorized by Mertz Productions.
- Not attempt to access another event's data, another user's account, or any part of the system you haven't been granted access to.
Third-party services
kylefyle integrates with QuickBooks Online, Dropbox, Vimeo, and Google services to coordinate event data and files. Each of these providers operates under its own terms of service; Mertz Productions is not responsible for those providers' availability, changes, or outages.
Ownership
kylefyle itself — its design, code, and functionality — is owned by Mertz Productions. Event content you upload or enter (schedules, files, notes) remains the property of Mertz Productions and, where applicable, its clients, and is used only to deliver the event you're working on.
No warranty
kylefyle is provided "as is." While we work to keep it available and accurate, we don't guarantee it will be uninterrupted or error-free, and we're not responsible for decisions made based on information in the system that turns out to be incomplete or out of date.
Limitation of liability
To the fullest extent permitted by law, Mertz Productions is not liable for indirect, incidental, or consequential damages arising from use of kylefyle.
Ending access
Mertz Productions may suspend or remove your access to kylefyle at any time, including after an event concludes or if these terms are violated.
Changes to these terms
We may update these terms as kylefyle evolves. The "Last updated" date above reflects the most recent revision. Continued use of kylefyle after a change means you accept the updated terms.
